TERMS & LIMITATION OF DATA RECOVERY

1. Recovery Limitations

 

I understand that data recovery results are not guaranteed to be 100% complete. Recovered files may not retain their original file names, folder structures, extensions, metadata, or timestamps. Some files may appear under different names or formats but may still be partially or fully usable.

 

2. Corrupted or Unusable Files

 

I understand that some recovered files may be partially recovered, corrupted, unreadable, or unusable (“garbage data”) due to factors such as overwriting, physical or logical damage, file system corruption, encryption, or prior repair or recovery attempts.

 

3. Factors Affecting Recovery

 

I understand that data recovery success depends on multiple factors, including but not limited to:
* Type of device and storage technology
* Level and type of damage (logical and/or physical)
* Overall condition of the device
* Actions taken after data loss (continued use, formatting, overwriting, repair attempts, etc.)

 

4. No Guarantee

 

I acknowledge that Daniel’s Gadgets Repair provides no guarantee or warranty regarding the completeness, accuracy, integrity, usability, or availability of any recovered data.

5. Data Delivery Method

 

I understand that recovered data will be returned on an external storage device provided by me, or on a new external storage device supplied by Daniel’s Gadgets Repair at an additional cost, if required.

 

6. Confidentiality

 

I acknowledge that all recovered data will be handled with strict confidentiality by Daniel’s Gadgets Repair and will not be accessed, copied, shared, or disclosed beyond what is necessary to perform the data recovery service or as required by law.
 
7. Liability Waiver & Limitation of Responsibility

 

I acknowledge and agree that the data recovery service provided by Daniel’s Gadgets Repair is performed on a best-effort basis only. I understand and agree that Daniel’s Gadgets Repair shall not be held liable for:

* Failure to recover some or all data
* Partial, incomplete, corrupted, or unusable recovered data
* Loss of existing data during diagnosis or recovery attempts
* Changes to file names, folder structures, formats, or metadata
* Any pre-existing damage, data loss, or device failure

 

I further agree that Daniel’s Gadgets Repair shall not be responsible for any indirect, incidental, special, or consequential damages, including but not limited to loss of business, loss of profits, loss of personal or professional data, downtime, or any financial losses resulting from data loss or recovery outcomes.

 

I understand that data recovery attempts involve inherent risks, including the possibility that the device or remaining data may become further damaged or permanently unrecoverable, and I voluntarily accept these risks
